Imphal, June 20 2022: Special Judge of fast track special court No 1 Manipur sentenced one Irom Rakesh Singh alias Naoba (25), who was earlier convicted in a case relating to outraging modesty of a minor girl, to 10 years imprisonment.
During sentence hearing of the case on Monday, the defence counsel contended that the convict has no record of committing any crime in the past and prayed for reducing the sentence period while the special PP argued for giving stern punishment to the convict as the victim is very young and just beginning to go to school so that no such incident occurs in future.
After hearing both the sides, the court while considering nature of the crime committed by the offender and suffering of the victim sentenced Rakesh to 10 years imprisonment under Section 6 of POCSO Act, 2012 and also told the offender to pay Rs 10,000 as fine.
The court also ordered that Rakesh’s jail term could be increased by three months if unable to pay the fine.
When the defence counsel prayed for reducing jail term of the offender who had been in jail for 10 months and 14 days during the trial of the case, the court agreed and sentenced Rakesh to work in jail for nine years, one month and 16 days and the jail term could be extended by three months if unable to pay fine.
The counsel for the victim, in view of physical and mental trauma suffered, also prayed for providing compensation and proper rehabilitation to the victim under Section 33 (8) of POCSO Act, 2012.After hearing the prayer, the court ordered to provide Rs 1 lakh as compensation to the victim either from the state government’s victim compensation fund or under Section 357-A of the CrPC or under relevant law of the state government.
